Managing Environmental Risks in Property Transactions The aim of this course is to arm property lawyers with the essential knowledge to enable them to effectively deal with environmental problems that arise in property transactions. The seminar looks at a variety of environmental risks including asbestos, regulatory compliance and contaminated land. We look at the checks that need to be made in order to find out about the environmental state of a property including due preliminary statutory enquiries, the use of environmental reports and how to make use of the Environmental Information Regulations. The course will review the contaminated land regime and alert practitioners on certain provisions in property contracts and leases that can trap the unwary. (1 hour CPD credit)Technical issues of contaminated land Explains why contaminated land is so problematic and often costly to remedy. Different types of sources are discussed. Specific contaminants and their potential effects are discussed. Case studies that highlight how contamination issues have effected real sites are identified. Finally a brief explanation is provided that explains how environmental reports have recently developed into rapid screening tools and what drivers exist for professionals ordering these reports. (1 hour CPD credit)Environmental Information for property lawyers Assesses the scope of the Environmental Information Regulations 2004 and how the provisions can be used by property professionals to practical advantage. It also considers environmental data obtainable from private organisations and the interpretation of such data. (1 hour CPD credit)Corporate Environmental Due Diligence Focuses on the basics of corporate due diligence and how environmental due diligence forms an important part of the overall process. It looks in detail at the steps sellers and buyers have to take in order to effectively manage their process. There is also a section looking at the drafting of warranties and indemnities and risk transfer options through insurance. The seminar is designed to provide practical information and is given by Simon Boyle Argyll's Legal Director who has had 10 year's experience in the industry during which he worked on many large corporate transactions worldwide. (1 hour CPD credit)Introduction to Environmental law Aimed principally to give the property lawyer basic information about essential elements of environmental law including the development of environmental law, common law, contaminated land, waste, water pollution and statutory nuisances. The course looks in more detail to the management of environmental risks in property transactions and how to draft contractual provisions. (4 hours CPD credit)CPD modular training Our modular training programme is an one hour lecture comprising of 2 or 3 different topics.
